    Information on export of arts and antiquities

    Export of arts and antiquities from the territory of the Republic of Poland is regulated by:

    1. EU regulations:

    • Council Regulation (ECC) No 116/2009 of 18 December 2008 on the export of cultural goods (OJ L 39 of 10.02.2009);
    • Commission Regulation (ECC) No 752/93 of 30 March 1993 laying down provisions for the implementation of Council Regulation (EEC) No 3911/92 on the export of cultural goods (OJ L 77, 31.3.1993).

    2. Polish regulations:

    •  Act of 23 July 2003 on the protection of arts and antiquities (Journal of Laws No 162, item 1568, amended);
    •  Regulation of the Minister of Culture and National Heritage of 18 February 2011 on model documents indicating the creation time of the monument, its appraisal and confirmation of its entry into the territory of the Republic of Poland (Journal of Laws No 50, item 256);
    • Regulation of the Minister of Culture and National Heritage of 18 April 2011 on export of cultural goods (Journal of Laws No 89, item 510).

    According to Act of 23 July 2003 on the protection of arts and antiquities, the following categories of arts and antiquities require a single licence for permanent export:

    1.      archaeological objects which are part of archaeological collections or which are the products of excavations or accidental discoveries, of an age exceeding 100 years;

    2.      elements forming an integral part of monuments of architecture, interior decoration, statues, and craftworks, of an age exceeding 100 years;

    3.      paintings, other than those in point 4 and 5, produced in any technique and on any material, of an age exceeding 50 years and of a value exceeding 40 000 PLN;

    4.      water-colours, gouaches and pastels, produced on any material, of an age exceeding 50 years and of a value exceeding 16 000 PLN;

    5.      mosaics, other than those falling in point 1 or 2, and drawings produced by any technique and on any material, of an age exceeding 50 years and of a value exceeding 12 000 PLN;

    6.      original engravings with their respective plates and original posters, of an age exceeding 50 years and of a value exceeding 16 000 PLN;

    7.      original sculptures or statuary and copies produced by the same process as the original, other than those in point 1, of an age exceeding 50 years and of a value exceeding 20 000 PLN;

    8.      photographs, films and negatives thereof, of an age exceeding 50 years and of a value exceeding 6 000 PLN;

    9.      manuscripts , singly or in collections, of an age exceeding 50 years and of a value exceeding 4 000 PLN;

    10.  books more than 100 years old and of a value exceeding 6 000 PLN,  singly or in collections;
